1. Introduction

These Terms & Conditions govern all reservations made on www.amigoresorts.co.uk, www.secretresorts.co.uk and www.dreamresorts.co.uk, hereafter collectively known as the “Website”. Except where otherwise specified, Funway Holidays International Inc., a company incorporated in the United States of America, with UK establishment number BR001433 and UK establishment office address of Third Floor, Northside House, 69 Tweedy Road, Bromley, BR1 3WA trading as “Amigo Resorts”, “Secret Resorts” and “Dream Resorts” (“we”, “us”, “our”) act only as an agent in respect of all reservations you make on this Website. We accept no liability in relation to any contract you enter into or for any accommodation arrangements or other services you purchase (“Arrangements”) or for the acts or omissions of any supplier or other person(s) or party(ies) connected with any Arrangements. For all Arrangements, your contract will be with the operator/supplier of the accommodation arrangements in question (the “Supplier/Principal”).

In these Terms & Conditions, references to "you" and "your" include the first named person on the reservation and all persons named on the reservation. Your reservation and use of our Website is subject to these Terms and Conditions, our Privacy Policy, and our Website Terms of Use, as well as the specific terms and conditions of the Supplier/Principal you contract with, and you must read all carefully.

By making a reservation on this Website, the first named person on the booking agrees on behalf of all persons named on the reservation that they:

a. have read these Terms & Conditions and agree to be bound by them;

b. consent to our use of personal data in accordance with our Privacy Policy and is authorised on behalf of all persons named on the reservation to disclose their personal details to us, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements); and

c. is over 18 years of age and resident in the United Kingdom and where placing an order for services with age restrictions you declare that you and all members of your party are of the appropriate age to purchase those services;

d. accepts financial responsibility for payment of the reservation on behalf of all persons detailed on the booking.

2. Contract

When making a reservation on this Website, you will be entered into a contract with the applicable Supplier/Principal of the Arrangements, as specified on your confirmation invoice. As agent, we accept no responsibility for the acts or omissions of the Supplier/Principal or for the Arrangements provided by them. Your reservation is subject to these Terms and Conditions and the specific terms and conditions of the Supplier/Principal you contract with and you are advised to read both carefully prior to booking. In particular, you will be subject to the Supplier/Principal’s cancellation and amendment terms and charges and these will be displayed on the Website at the time of reservation. The Supplier/Principal’s terms and conditions may limit and/or exclude the Supplier/Principal's liability to you, and these will be available for you to view on the Website before you make your booking and will be supplied to you along with your booking confirmation.

Your reservation is confirmed and a contract between you and the Supplier/Principal will exist only when we send you booking confirmation on their behalf.

3. Prices

The price of your reservation will be displayed on the Website, and is inclusive of VAT/sales tax (unless stated otherwise on the Website, or in the Supplier/Principal’s terms and conditions). Additional fees and taxes (such as tourist/city taxes) may be charged by the Supplier/Principal in addition to the reservation price, and in some cases they may be charged locally.

You may be able to make a reservation at a lower rate, however please note that these lower rates may be subject to special conditions and restrictions (such as non-refundable) imposed by the Supplier/Principal. These special conditions and restrictions will be displayed on the Website.

We reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in both advertised and confirmed prices. Special note: changes and errors sometimes occur. You must check the price of your chosen Arrangements at the time of making your reservation. Obvious errors and mistakes (including misprints) are not binding

4. Payment

In order to make a reservation on the Website, you will be required to either make payment in full to the Supplier/Principal at the time of reservation, or guarantee your reservation with a pre-authorisation of your credit/debit card.

Where full payment must be made to the Supplier/Principal at the time of reservation, payments will be facilitated on the Website by us. We will facilitate payment on behalf of the Supplier/Principal only and will not act or operate as the merchant of record. Payment will be processed from your debit/credit card or bank account to the bank account of the Supplier/Principal through a third party payment processor. The Supplier/Principal’s details will appear on your bank or credit/debit card statement as the payee.

For certain rates, you may be required to make full pre-payment of the reservation amount and therefore your credit/debit card may be pre-authorised or charged at any time upon making your reservation. You must ensure you have sufficient funds in your account/card at any time from the date of your reservation up until check-in to ensure payment can be processed.

We have no liability to you for any charge made by the Supplier/Principal (whether authorised, (allegedly) unauthorised or wrong) in relation to your reservation and you cannot claim or reclaim any charges made by the Supplier/Principal from us (including in the event of any no-show or cancellation charges being imposed by the Supplier/Principal).

5. Insurance

We strongly recommend that you take out a policy of insurance in order to cover you and your party against the cost of cancellation by you; the cost of assistance (including repatriation) in the event of accident or illness; pre-existing medical conditions, loss of baggage and money; and other expenses.

6. Special requests

If you have any special requests (for example dietary requirements, cots or room location), please stipulate this at the time of making your reservation. All such requests will be passed on to the Supplier/Principal, but we cannot guarantee that they will be met and we will have no liability to you if they are not

7. Changes, Cancellations & No-Shows

If you wish to cancel or amend your confirmed reservation, you must contact us, either by telephone in writing by email. All amendment and cancellation requests will be dealt with in accordance with the Supplier/Principal’s terms and conditions, including any special conditions or restrictions that were displayed on the Website at the time of reservation.

Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will try to assist, we cannot guarantee that the Supplier/Principal will meet such requests.

Depending on the type of reservation you have made, it may be non-refundable which means that cancellation will incur a 100% cancellation charge and no refund will be paid to you by the Supplier/Principal in the event of cancellation or amendment. Where your reservation does allow for amendments and cancellations, these may be subject to certain restrictions and you may not be able to make changes and cancellations free of charge after a certain date. Please check the

Supplier/Principal’s terms and conditions which apply to your reservation to see the conditions which apply should you wish to change or cancel your reservation. In addition, you must pay us an administration fee of £[TBC] per booking for any amendments to bookings and an administration fee of £[TBC] for cancellations.

Please note that there is no automatic statutory right of cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Directive 2011/83/EU).

8. Our responsibility for your reservation

Your contract for the Arrangements is with the Supplier/Principal and its terms and conditions apply. As agent, we accept no responsibility for the actual provision of the Arrangements. Our responsibilities are limited to making the Arrangements available to book on the Website. We accept no responsibility for any information about the Arrangements that is displayed on the Website in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to the price of your reservation (or the appropriate proportion of this if not everyone on the reservation is affected). We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment.

9. Visa, passport and health requirements

Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. Neither we nor the Supplier/Principal accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Please note that these requirements may change between booking and departure. Most countries now require passports to be valid for at least 6 months after your return date.

10. Complaints

Because the contract for your Arrangements is between you and the Supplier/Principal, any queries or concerns about your Arrangements should be addressed to them. If you have a problem with your Arrangements whilst using them, this must be reported to the Supplier/Principal immediately. If you fail to follow this procedure there will be less opportunity for the Supplier/Principal to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result.

If you wish to complain when you return home, please contact the Supplier/Principal. You will see their name and contact details in any confirmation documents we send you. We will of course assist you with this if you wish - please contact us. If the matter cannot be resolved and it involves us or another ABTA Member then you have the option to use ABTA’s ADR scheme, approved by the Chartered Trading Standards Institute, see www.abta.com. You can also access the European Commission Online Dispute (ODR) Resolution platform at http://ec.europa.eu/consumers/odr/. This ODR platform is a means of notifying us of your complaint; it will not determine how your complaint should be resolved.

If you wish to complain about any service we have provided to you (i.e. our booking service) then please contact us directly.

11. Law and Jurisdiction

These Terms & Conditions are governed in all respects by English law. We both agree that any dispute, claim or other matter which arises between us out of or in connection with your use of the Website and/or your reservation will be dealt with by the Courts of England and Wales only. You may however, choose the law and jurisdiction of Scotland or Northern Ireland if you live in those places and if you wish to do so.

12. Accommodation Ratings and Standards

All ratings are as provided by the relevant Supplier/Principal. These are intended to give a guide to the services and facilities you should expect from your Arrangements. Standards and ratings may

vary between countries, as well as between suppliers. We cannot guarantee the accuracy of any ratings given.

13. Documentation & Information

All descriptions and content on our website or otherwise issued by us is done so on behalf of the Supplier/Principal in question and is intended to present a general idea of the services and facilities provided by the Supplier/Principal. Not all details of the relevant services and facilities can be included on the Website. All services and facilities shown are subject to availability. If you require any further details, in respect of any Arrangements or any other services please contact the relevant Supplier/Principal.
